LMPD investigating after shooting at Louisville Waffle House; What we know

LMPD Detectives are still working to determine what led up to the shooting.

LOUISVILLE, Ky. — One person is in police custody and another is injured after a shooting at a Louisville Waffle House on New Year's Day.

Louisville Metro Police (LMPD) said Third Division officers responded to the shooting in the 10500 block of Dixie Highway around 12:30 p.m. 

Authorities said they found a man inside the restaurant suffering from a gunshot wound. He was alert and conscious when EMS arrived, and was transported to the University of Louisville Hospital. The victim is expected to survive his injuries.

LMPD Detectives are still working to determine what happened prior to the shooting, however the victim's son spoke with WHAS11 News. He said his dad and the suspect share a "history."

"It's just an ongoing thing, the guy wasn't supposed to be around any of us," Eric Stovall said. "My dad came over here to get some food, dude was in there, pulled a gun out and shot my dad in the back."

The victim's daughter spoke with WHAS11 News on Saturday, saying all of his vitals look good and they hope he will be moved out of the ICU soon.

According to police, 19-year-old Dominick Mack was arrested at the scene and charged with violating an Emergency Protective Order. 

The judge released him from jail without bond.

The department's Non-Fatal Shooting Unit is handling the investigation.
