ISP: No charges filed in deadly shooting of Salem man

Police determined the victim acted in self-defense after a early Sunday shooting on North College Avenue.

LOUISVILLE, Ky. — Indiana State Police said no charges will be filed in connection to a deadly shooting in Salem.

Troopers with Indiana State Police and officers with Salem Police responded to the 500 block of North College Avenue just after midnight on Jan. 28 regarding the incident.

In their original investigation, police determined Blake Henry shot 29-year-old Jacob Mitchell inside the home. There were also two women inside who police said were witnesses.

The investigation states Henry and the two women were taken to the Washington County Sheriff’s Department and interviewed by ISP.

Henry told investigators that he had been “battered” by Mitchell multiple times during the incident. They also revealed Mitchell assaulted one of the women and shattered a glass cabinet in a "fit of rage".

ISP said one of the women told them they were unsure what Mitchell would do next until he physically charged at Henry and Henry fired the fatal shots.

Henry then called 911 and police said he could be heard via dispatch giving commands to “apply pressure”. All inside, police said, were attempting life-saving efforts. The ISP said Henry repeatedly told first responders to come and save Henry.

Police concluded Henry was the homeowner and he allowed Mitchell to stay with him due to previous legal issues in Lawrence County.

Investigators determined Henry had acted in self-defense. He was arrested, but not formally charged.
