Family of man shot by LMPD officer questions their actions

A family is disputing claims that their relative didn't shoot at Metro Police after an officer-involved incident at Breckenridge Square Apartments early Saturday.

LOUISVILLE, Ky. (WHAS11) – Louisville Metro Police released the body camera video over the weekend regarding the officer-involved shooting at an eastern Jefferson County apartment complex.

LMPD says the video shows Elijah Eubanks refusing their commands while inside a vehicle. Moments later, LMPD says Eubanks fired at officers with a revolver.

But, his family disputes Eubanks used it. "I never seen my nephew pull a gun. You open fire five times. Is that justifiable? Did you have to shoot five times? Once was enough," Eubanks' Aunt Marja Ellis said.

LMPD did recover a revolver on the scene, which LMPD Major Frank Hardison says Eubanks fired once.

Ellis also questions why Eubanks' father had to wait hours before getting an update on his son, learning first of the shooting by watching the news. She says he wasn't even allowed inside the hospital.

"Where do we go? That's where we are lost at. What do we do? We can't see him. We can't talk to him. Just yesterday, we got medical news on my nephew," she told WHAS11.

She says Eubanks is in stable condition. Ellis believes the video provides more questions and answers and she hopes LMPD is transparent in its investigation.

LMPD Chief Steve Conrad promises a thorough review. "It's only going to be through a thorough and complete investigation. Then we are going to be in a position to say whether or not a use of force is justified," he said.
