Hung jury in case of bus driver accused of letting students engage in sex act

Kristy Lawrence is accused of letting students as young as 12 years old engage in a sex act on the bus.

LOUISVILLE, Ky. (WHAS11) – After three days, 6 jurors could not come to a unanimous verdict.

“It's kind of like a tie game, you know? It's something we would've preferred to have it over with and have it behind her,” Jimmy Nicholson, Lawrence’s attorney said.

Former JCPS bus driver Kristy Lawrence still awaiting her fate as the trial ended today in a hung jury. After an incident on the school bus in August 2014, she was charged - authorities say she didn't do enough to prevent students from engaging in a sex act on the bus.

For the first time today we heard Lawrence's side of the story.

Prosecutor: Does the mirror show you what's going on in the seat immediately behind you below the seat?

No,” Lawrence said.

Prosecutors say a 17-year-old boy and a 12-year-old girl engaged in a sexual act in the seat directly behind Lawrence. In Lawrence's testimony she says from her position on the bus she could not see what was happening and no one told her it was happening.

Prosecutor: Had you known this activity was going on behind you what would you have done?

I would have pulled the bus over and took care of the situation,” Lawrence said.

But prosecutors say video from the bus shows a different picture.

“She knew about it. Her behavior let us know that she did in fact know about it but all she's tried to do since and cover saying she didn't know, she only heard what they were saying. That she didn't see anything, that she couldn't see,” the Jefferson County Assistant Prosecutor said.

But after nearly four hours of deliberation, jurors could not come to a verdict.

Lawrence's case is on the docket for tomorrow. The county attorney will now decide if they want to retry Lawrence. Her attorney says she is prepared to defend her innocence again.
