Alleged repeat victim of former soldier charged with rape speaks out

LOUISVILLE, Ky (WHAS11) -- A former soldier is charged with rape and burglary after the mother of two of his children says he forced his way into her home and sexually assaulted her while the kids looked on.  For the alleged victim it was a chilling case of déjà vu.

“I was scared to death, I didn't know what to do”, Michelle Chowdhury said.

She was in the bathtub when she says her ex-boyfriend broke into her home, walked past her four children, and began to attack her.

She says he climbed into the bath tub, bit her, and tried to force her to have sex.

“That's all I could think about laying in that water, do I do what he says or do I fight back?

She chose to fight, and says she was able to stop him from completing the rape...this time.  However her history with the suspect Francisco Beltran goes back to 2006 when they met in rehab, and began a relationship.

“That's kinda when everything fell apart, I lost my home, I lost my children, that's when the physical abuse started”, the mother of seven recalls.

Chowdhury and the accused have been in court several times over the last six years about custody of their two children and the no contact order she had against him.

In 2008 Beltran was arrested not just for violating that order, but on accusations he raped and sodomized Chowdhury.  He pleaded guilty to violating the protection order but the assault charges were dropped.

“I was in active addiction, I was drinking, I couldn't remember if it happened or not and it just didn't hold up in court”, Chowdhury said.

She says much of the abuse she's suffered has come down to he said she said and although she's been clean for nearly three years, and Beltran was arrested and charged for burglary and rape, she worries she's not as believable as he is. 

“I feel that because he has military and army background that his words are more credible than mine, I’m not as educated as him”, Chowdhury said.

However, in an even more disturbing twist to Tuesday’s alleged sexual assault, Chowdhury says her children witnessed the assault, so it may no longer just be her word against his.

“Sad to say that it has to be my child to witness what happened yesterday, but hopefully this is what gets him put away”.

Fort Knox Human Resources Command tells us Beltran served there for about seven months.  He was discharged in 2004. 

We did contact Beltran to give him a chance to tell his side of the story, but he did not wish to be interviewed.
