(WHAS11) -- An Indiana sanitation employee got the surprise of his life when he found something moving inside a trash bag.
Michael Upchurch met a puppy he has now named "Garby" (short for garbage). His first owner had thrown the puppy in the trash thinking the animal had died of Parvo.
Upchurch found the dog by chance as he was picking up trash on Main Street in Muncie, Indiana and will now keep it. Upchurch heard whimpering and at first thought it was his co-worker but later discovered it was a puppy.
Officials say the dog did not have Parvo but was starving and had passed out and they believe the owner thought it had died. They say Garby's former owner has been cited with animal neglect and animal cruelty.
The prosecutor will have to decide whether to press charges.
