A Kentucky Derby-winning trainer is appealing a 30-day suspension issued by the Kentucky Horse Racing Commission for violating doping rules. Rick Dutrow argues in the appeal that the commission violated his due process rights, improperly admitted new evidence at a hearing and that the suspension was “not based on substantial evidence.” Dutrow, who won the 2008 Kentucky Derby with Big Brown, was suspended last week after tests revealed that one of his horses, Salute the Count, had an excessive amount of Clenbuterol in his blood after finishing second in a 2008 race at Churchill Downs. The racing commission also ordered Dutrow to return the purse money won by the horse. Dutrow filed the appeal Friday in Franklin County Circuit Court. His attorney, Frank Becker, did not return a call on Wednesday.
