Frankfort, Ky. (WHAS11)- Tuesday morning in Frankfort, lawmakers will be discussing and possibly voting on an amendment that could abolish the job of Jefferson County Constable.

It comes one day after Constable David Whitlock appeared before a judge.

Whitlock has been ordered to stay away from Tammie Ortiz.

She is the suspected shoplifter he is accused of shooting last year in a Wal-mart parking lot.

Whitlock initially told police he shot at Ortiz after she ran over his foot, now surveillance video questions whether that is really what happened.

Whitlock's attorney says it was an accident.
 
Whitlock pleaded not guilty to felony charges of assault and wanton endangerment. 

A judge also ordered him to surrender all of his firearms.
