Man shot, apparently tried breaking into house

WHITESBURG, Ky. (AP) — A grand jury will determine whether to charge a Letcher County man after an apparent burglar was fatally shot.

According to the Lexington Herald-Leader (http://bit.ly/QzgCxd ), 37-year-old James Duff of Cumberland was shot at a house in the Gordon community of neighboring Letcher County.

Police said James Brown, who was at the house, confronted Duff and the two argued. Troopers said Brown had a pistol and he shot Duff in the chest. The shooting occurred about 11:15 p.m. Wednesday.

The KSP did not file immediate charges and said evidence will be presented to a grand jury.
