Man accused of TARC shooting acts up during court appearance, victim's family devastated

Louisville, Ky. (WHAS11) - On Monday, a Louisville murder suspect – Apollo Avery – talked in court about a shooting on a TARC bus. Police charged Apollo Avery with killing a man who was apparently trying to break up a fight. WHAS11's Adrianna Hopkins talked to the victim's family.

“What you say can be used against you...” said the Judge to Apollo Avery in his arraignment hearing.

22-year-old Apollo Avery appeared in court this morning, with a black eye, a bruise on the side of his head and plenty to say. He faces murder charges stemming from the shooting death of 26-year-old Timothy Barbour.

“This goes out to the family of the victim. I had no parts in what happened to that man. The situation escalated. You got the wrong man for the crime,” said Apollo Avery in court.

“He was beautiful. I loved my brother. He was kind. He’d do anything for anybody. He loved his kids. He was a great guy. He’d do anything for anybody,” said Timothy Barbour’s older sister Sheketa.

Sheketa Barbour says police told her family, her brother died doing just that – helping someone else. Police say Saturday night a fight broke out on the TARC bus Timothy was riding. Timothy jumped in to help two young girls he knew. Then everyone involved got off the bus at 10th and Broadway. That’s where Timothy was shot and killed.

“Someone spit on her... punched her in the face. A normal person, like I said, with any type of decent morals would help and he went back there and helped. It basically escalated and he’s gone,” says Sheketa.

Sheketa says she’s devastated. She’s lost her only brother and their mother spent Mother’s Day without her son.

‘My mom’s not doing well at all. She’ll be okay though,” said Sheketa. “He was the greatest brother in the world. He was my only brother. I loved him. But we’ve got his kids, we’ve got memories.”

The family’s traumatized. Sheketa says she’ll never ride TARC again. As for TARC, they say their number one concern is passenger safety. Apollo Avery is still in jail on a $500,000 bond. Timothy leaves behind his mother, two sisters, and three children – a 10-year-old, 7-year-old and 5 month old.

(WHAS11) - One man was killed and another was taken to University Hospital after gunfire errupted following a fight aboard a TARC bus Saturday night.

Around 10:40 p.m., on a bus headed eastbound on Broadway, a fight broke out aboard that bus. When those involved exited the bus, gunshots rang out.

Police are still looking for the shooter(s).
