LOUISVILLE, Ky. (WHAS11) – Federal court records filed by the city said that police were justified in the shooting of Darnell Wicker. He is the man police said was holding a tree saw when officers responded to a domestic dispute in South Louisville in August.
It’s important to note that there has been no determination that the deadly shooting of Darnell Wicker was justified. This is only in response to the civil lawsuit filed by Wicker's daughter's — that determination will be coming from the commonwealth attorney.
At last check, the officers who shot Wicker remain on administrative re-assignment. LMPD's Public Integrity Unit is still investigating those officers and the circumstances surrounding Wicker's death.
The Jefferson County Attorney's office is representing the city, and LMPD sent us a statement which said in part, “We raised all possible defenses as required by law, otherwise they could be considered waived. The results of the ongoing investigations will determine which, if any, of these defenses would be applicable.”
