LOUISVILLE, Ky. (WHAS11) -- The U.S. Government has the green light to order its own independent health evaluation of the founder of USA Harvest, Louisville's Stan Curtis, who was not able to attend a scheduled arraignment on Thursday.

Curtis appeared in frail health and confused in December at this court appearance. Afterwards he went to a Louisville nursing home where his wife Jeannie says he has some kind of brain disorder.

Curtis is accused of embezzling from USA Harvest. ON Thursday his attorney says he's still too sick to appear in court and he's on a feeding tube.

“I can tell you that you know, he has multiple issues. They have affected him mentally,” Scott Cox, Curtis’ attorney, said.”He was supposed to have surgery this month to reverse a colonoscopy but he was too ill to have that.”

Cox says the feeding tube has helped Curtis gain some weight.
