Louisville, Ky. (WHAS11) - Suspected killer Cecil New was back in court and fighting to have testimony removed from the court record.

New is charged with killing 4-year-old Ivan Cano in 2007.

A K-9 search and rescue worker, Amy Womack, identified Cecil New in court.

She said he looked suspicious at the crime scene back in July 2007.

Cecil New faces murder and kidnapping charges for the death of 4-year-old Ivan Cano.

Womack told detectives her dog sniffed around the basement door of New's apartment.

She says he suddenly walked out looking scared.

A judge is considering whether her testimony will be allowed in the trial.

A lead detective will testify in court on March 29th.
