Louisville, Ky. (WHAS11) - Louisville Metro Police say right now their investigation doesn’t show that a second grader at Frayser Elementary School was attacked before he was found hanging from a hook in the bathroom.
The 8-year-old was found unresponsive last month at the school near Churchill Downs. He has now recovered from his injuries but police don’t know how he ended up on the hook and what happened when he was in the stall.
“At this point we have not been able to substantiate or corroborate any information that would lead us to believe that foul play is involved,” said Sgt. Robert Biven with LMPD. Biven said the student was in a locked stall alone and the hook he was found hanging from by his collar is shorter than his height. The child’s family says two fifth graders attacked him. Police say the students’ whereabouts have been accounted for.
“Based on the info we’ve received we do not believe that these individuals are involved. I was told by our detectives that their whereabouts were accounted for in classrooms, in different classrooms, at that particular time,” said Biven.
Teddy Gordon, the attorney for the child and his family, says "I am not able to agree or disagree with the responsive statements from LMPD, because they have failed to provide me with whatever evidence they obtained. From the very beginning I have always taken the position to fully investigate this case without a predisposed outcome."
Gordon has said two fifth graders attacked the boy because he told adults about them bullying him on the school bus.
Police say their investigation is far from over. They are still waiting on medical records that may reveal what happened in that bathroom stall.
