Man on trial for murder during 2009 ice storm

LOUISVILLE, Ky. (WHAS11)—   A brutal murder went down when Louisville was iced over two years ago, but prosecution is having a tough time proving who fired the gun.

William Wagner was shot in the back of the head in January 2009.  A medical examiner testified that a single bullet was lodged in his brain.

Gary Lindsey was charged with murder and tampering with evidence. But today in court, it was hard for neighbors to identify who pulled the trigger.

Ida Airhart said in court that she heard three rapid fire gunshots near her home at 28th and Main Street in Portland that woke her up.

"I had seen it started to snow. I looked up and down the street and saw three people walking in the middle of the street going west on Main Street," she said.

The crime scene unit had to melt snow and ice to uncover bullet casings due to the freezing rain and snow the night of the murder.

The jury trial resumes tomorrow.
