LOUISVILLE, Ky. (AP) -- A Kentucky woman who is within weeks of being released from prison plans to ask an appeals court to clear her name in the 1998 shooting death of her boyfriend in Spencer County.

Susan Jean King is scheduled for release from prison on Nov. 30. She's been jailed since entering an Alford plea in 2008 in the death of 40-year-old Kyle "Deanie" Breeden of Shelbyville a decade earlier.

A Spencer County judge on Monday ruled that, even though another man has claimed responsibility for killing Breeden and later recanted the statement, King has not made a case for overturning her plea.

King's lawyer, Linda Smith of the Kentucky Innocence Project, says the Kentucky Court of Appeals will be asked to exonerate King.
