GLASGOW, Ky. (AP) -- A southern Kentucky jailer who agreed to resign next year as part of an Alford plea to sex abuse charges has filed a lawsuit claiming the county has already stopped paying his salary.

The Glasgow Daily Times reports that Barren County Jailer Leland E. Cox filed the lawsuit Tuesday. Cox's attorney, Steven Thornton, says the county has no legal standing to stop paying Cox.

Part of Cox's plea agreement on the misdemeanor charges called for him to officially remain jailer until January 2010, but have no oversight of the operations or contact with employees.

Judge-Executive Davie Greer said county officials took action after hearing from community members that "they didn't want their tax dollars paying his salary, so that's what we decided to do."

The lawsuit asks the court to immediately restore Cox's wages and benefits. It also seeks punitive damages.
