Judge overturns conviction against jockey

LOUISVILLE, Ky. (WHAS11)-- A judge has overturned a misdemeanor assault conviction against jockey, Robby Albarado, on appeal.

The judge, Brian Edwards, said a comment made by the prosecution during jury selection was prejudicial.

Albarado had been previously found guilty and fined $500 for a fourth degree wanton assault charge he received for his role in a 2012 altercation, involving his former girlfriend, at his home.

Judge Edwards sent the case back to trial court for a new trial.
