(WHAS 11) -- A Jefferson County constable charged with Assault and Wanton Endangerment intends to enter into a plea deal next week.
David Whitlock's attorney confirmed late Friday that his client has reached an agreement with prosecutors that will allow him to avoid a trial.
Police say Whitlock shot Tammie Ortiz in a Wal-mart parking lot after store security guards notified Whitlock that Ortiz was suspected of shoplifting in the store.
Whitlock turned down an earlier agreement which would have placed him in a felony diversion program, if he pledged not to again seek employment in law enforcement.
He's now due back in court Tuesday morning.
