LOUISVILLE, Ky. (WHAS11) – The father of a boy found unconscious in a bathroom at Frayser Elementary last year has filed a lawsuit against the school principal, the boy's teacher, and two fifth grade students who were allegedly involved.

The 8 year-old boy was found hanging by his collar in the school restroom in March of 2011.

In the lawsuit, his father alleges the fifth graders had bullied the boy on the bus before the alleged incident happened in the restroom.

The fifth graders are accused of battery and the school principal and the teacher are accused of negligence.

WHAS11 is expected to learn more in a news conference, scheduled for Tuesday afternoon.

Jefferson County Public Schools can't comment on any pending legislation.
