Shanklin fights ruling she violated multiple ethics codes with appeal

LOUISVILLE, Ky. (WHAS11) -- Councilwoman Barbara Shanklin is fighting back against a ruling she violated multiple ethics codes.

Just days after five council members began the process to remove her Shanklin's attorney has filed an appeal.

On Monday, April 1, Barbara Shanklin's attorney filed an appeal of an ethics committee ruling handed down two weeks ago.

The ruling says Shanklin used her office to her own benefit.  And they recommended the Metro Council remove her from office.  Her attorney says the ethics committee's decision isn't supported by evidence.

On Monday afternoon Barbara Shanklin's attorney filed an appeal of the Metro Ethics commission's findings that the councilwoman violated the four different sections of the Metro Ethics code including: using her position on the council to secure funds for a neighborhood association she ran and hiring and serving as her grandson's direct supervisor.  Monday's appeal argues that the ethics commission’s findings are flawed, and not specific enough.

 “They found that my client had enjoyed unwarranted privileges, but there is no discussion no definition of unwarranted privilege as you would get if you had a jury deciding a case,” Aubrey Williams, Shanklin’s Attorney, said.

Shanklin's appeal does not directly affect the other pending actions against her.  The following is what the councilwoman faces:  on the civil side, the Metro Ethics Commission has found her guilty of violating the ethics code and recommended the Metro Council remove her from office.  That's what Shanklin's attorney appealed Monday.

Shanklin also faces criminal charges completely separate from Monday's appeal. LMPD’s Public Integrity Unit conducted an investigation and turned it over to a special prosecutor.  The special prosecutor has not yet announced whether they'll go forward with charges against her.
