Witness in Cecil New case allowed to testify outside courtroom

Louisville, Ky. (WHAS11) - A key witness in the Cecil New case will get a chance to testify outside of a courtroom.

Cecil New was back in court Monday. He's the Louisville man charged with killing 4-year-old Ivan Cano in 2007.

Prosecutors asked a judge to allow a woman to testify who claims she saw Cecil New spraying bug spray around a trash can close to the time of the boy's disappearance.

Prosecutors were worried about the 80-year-old woman's health and that's why they asked for a written or video deposition.

The judge says the details of the testimony are still being worked out.

New's trial will begin in February
