A Jeffersontown woman says she's being forced out of her home all in retaliation.
Jennifer Samson says the landlord wants her out in three days because she complained to the health department about mold.
The tenant says she went to her landlord about mold that she said was harming her health and that of her 3 children.
She says that her landlord told her he would get to it eventually, but she contacted Louisville Metro Inspections Licenses and Permits to look into it.
Now, that agency has opened a case against the landlord and the tenant has been told to leave.
When Jennifer Sampson moved into her apartment on Michael Edward drive 2.5 months ago, she said she was looking for a healthy home for herself and her three children.
She said what she soon discovered was that it was anything but.
Sampson says water often pours through the ceilings and into the walls of her downstairs unit.
Mold was found everywhere, especially in her three year old daughter's room.
“They came in here and tore up the carpet, left all the mold in there,” said Sampson.
So Sampson said she notified her landlord Charles Gallahue about the problem.
“I told him that it was bothering my health. My eyes were swelling up I had 3 kids in here. He told me he'd get to it at a later date and told me that mold won't bother me. don’t worry about it,” she said.
So Sampson called the inspector, who came out and wrote up the problem and gave Gallahue two weeks to fix the problem.
Five days later, she says she received a letter informing her she was being evicted.
“He's evicting me because he has failed to clean up the mold. He has failed to keep his apartments up and I am getting evicted because I said something,” said Sampson.
WHAS11’s Adam Walser talked to Charles Gallahue, the landlord, Tuesday by phone.
He said the eviction letter had nothing to do with the report to the health department, but was because he suspected she had people who were not listed on her lease living there.
He says he will allow her to stay until she gets a new apartment and will refund her security deposit.
Sampson told us that she found another place for her family to live earlier Tuesday and plans to move into her new apartment before Christmas.
