LOUISVILLE, Ky. (WHAS11) -- The trial for 17-year-old Josh Young is underway.
The defense and the prosecution presented opening arguments Wednesday morning.
Young's attorneys said the boy, just 15 at the time of Zwicker's murder, is innocent and his father, Josh Gouker is the real killer. The defense presented one motive for Gouker and said that he killed Trey because he was angry that his mom aborted their child. It’s a motive they say Young has nothing to do with.
Terry Zwicker, Trey’s father, took the stand and said that he was always concerned about his son living with Gouker and said that he had threatened his life, but he was not alarmed by anything Trey told him about Young.
“It wasn't nothing bad. He didn’t have any problems with him. He just didn't know how to take him,” Zwicker said.
Young is charged with Complicity to Murder and Tampering with Physical Evidence in the beating death of his step-brother, 14-year-old Trey Zwicker. It happened back in 2011 behind Liberty High School. Gouker pleaded guilty to the murder and was sentenced to life in prison last week.
He initially pointed all the blame at his son, but has since changed his story and said he acted alone. Prosecutors say Gouker told inmates that his son did play a role and they stated in court that they were prepared to present that information to the jury. Testimony is expected to continue on Thursday.
