LOUISVIILE, Ky- Testimony began today in the assault trial of jockey Robby Albarado. His ex-girlfriend took the stand first…and for nearly four hours told jurors about the alleged attack.
Carolina Martinez told a jury she had confronted him about cheating on her and took his cell phone. When she refused to give it back she says he ran after her, kicking down a door and pushing her to the ground.
The prosecution and defense are painting very different pictures of what led up to that alleged assault that landed Albarado behind bars Oaks Day. The defense says his accuser is a woman scorned out for revenge, and the prosecution says she's the victim of a man who turns to violence when he gets angry. The trial is expected to continue throughout the week. If convicted on the fourth degree assault charge, Albarado could face up to a year in prison.
