(WHAS11) - A special prosecutor will not be assigned to the David Camm trial.
Camm has been convicted twice of killing his wife and their two children in 2000. Both convictions were thrown out on appeal.
Camm's attorneys wanted Floyd County prosecutor thrown from the case but a judge has denied that request.
His attorneys argued that Henderson had signed a book deal but it no longer exists.
Camm's third murder trial is expected to get underway late this year.
