LOUISVILLE, Ky. (WHAS11) -- A night out ends in gunfire near Butchertown.

The victim, who still has not been identified for safety reasons, was critically injured in a drive-by shooting on Story Avenue, across from Lincoln Elementary in December.

Ryan Fuqua, has now been arrested and charged with assault in connection to the violent crime.
Police say he originally gave them a false name but they were able to identify him later through fingerprints.
The arrest comes as the victim was able to point out Fuqua from several photos.

The victim's family says he was shot because he booed someone's song at a performance last year.
They say what happened to his brother should be a real wake up call to young people who shoot first when addressing a problem

The victim remains hospitalized after the single gunshot wound to the stomach.
He's had emergency surgery and has a long road to recovery.
