LOUISVILLE, Ky. (WHAS11) -- Louisville Metro Police arrested a Burlington, Ky. man Wednesday after he was found in a restroom of a Louisville eatery.

According to the police report, 24-year-old Zachary Foote was found by employees passed out in the ladies restroom at the White Castle on Market Street.

When police arrived at the restaurant, officers said Foote was inside a stall and they woke him.  Officers described hearing a shuffling sound and the sound of a metal lid shutting.

Foote came out of the stall and police detained him. Upon searching the stall, police said they found a brown leather pouch in the sanitary napkin disposal container. The report states the pouch contained a hypodermic needle, a burnt spoon and a black shoelace.

Police said Foote appeared to have "track" marks on his arm and his pupils were "pin-pointed."

Foote is charged with possession of drug paraphernalia, tampering with physical evidence and loitering.
