LOUISVILLE, Ky. (WHAS11) – A judge has denied a renewed motion to dismiss charges against Dejuan Hammond on July 18.
Hammond's attorney tried to have the case thrown out because the judge found prosecutors improperly withheld evidence from defense attorneys.
She said dismissing murder charges seems an extreme sanction.
Hammond will stand trial for the murder of Troya Sheckles in August.
In 2009, Sheckles was shot and killed in Shelby Park after agreeing to testify in the murder case against Hammond's brother Lloyd.
