LOUISVILLE, Ky. (WHAS 11)--A young man waits to learn if he will head to prison or not.
Andre Banks pleaded guilty in 2014 to bringing a loaded gun to Fern Creek High School and shooting at a fellow classmate but missing.
That bullet ended up hitting 15-year-old JaVaughn Tay Burroughs instead.
Those charges would have meant 18 years in prison but after hearing from a social worker who spoke about Banks' recovery, the judge sentenced him to 5 years probation.
Now prosecutors are attempting to revoke his probation and send him to prison.
