Makers Mark Distillery suing maker and distributor of Jose Cuervo Tequila

Posted on October 20, 2009 at 12:35 PM

A Kentucky bourbon producer is seeing red, over what it considers a trademark infringement.

Maker’s Mark Distillery is suing the makers and U.S. distributor of Jose Cuervo Tequila, for improper imitation of its bottle wrapping.

Maker’s Mark said a red, wax-like coating on some Jose Cuervo bottles resembles the quality of its branding.

The suit seeks to drain profits made from the packaging of some Jose Cuervo bottles.
