Louisville, Ky. (WHAS11)- The woman who will soon stand trial again for burning her own Saint Matthews business was back in court Wednesday.
Prosecutors say Susan Lukjan set fire to Campbell’s Gourmet Cottage next to Trinity High School in 2006.
She has previously been found guilty, but an appeals court overturned her conviction and ordered a new trial.
In court Wednesday, Lukjan's attorneys are trying to get their hands on e-mails between fire agencies.
The Commonwealth's Attorney says they do not have to turn over emails between law enforcement agencies, but they did give them to the court to review and a judge will make a decision at a later date.
Lukjan recently rejected a plea deal that would have sentenced her to time served.
She says she wants to clear her name and will stand trial in September.
