Servers suing, accusing Darden restaurants of not paying overtime

Miami, Fla. (WHAS11)- A federal lawsuit has now been filed against the company that owns popular restaurants like Olive Garden, Red Lobster and Longhorn Steakhouse.

Servers are suing Darden restaurants for back pay and other compensation, saying they were cheated out of overtime and not allowed to clock-in until customers arrived.

 The lawsuit, which was filed in Miami, looks to represent the company's current and former employees from August 2009 until now.

Servers say they were not properly paid for work like cleaning and preparation, and the suit also claims servers routinely were not paid overtime despite working more than 40 hours a week.

Darden is not commenting.
