HARDIN CO., Ind. (WHAS11) -- A Hardin County father is now facing murder charges after the death of his 1-month-old son. The charges were just upgraded from manslaughter.

Jarrod Davis told police at first that he dropped his son and then the infant hit his head on the crib.  The baby did have blunt force trauma but a grand jury said this was no accident.

Ja’Vion Davis was just 36-days-old and is survived by his two brothers.  His father was in court on Tuesday answering to the new charge of murder.  In the past week the grand jury indicted Davis on murder instead of the original charge of manslaughter.  Those with the Commonwealth’s Attorney’s office would not reveal all the evidence in the case but said the grand jury saw this case as a murder and no the lesser charge.  Davis is also charged with criminal abuse in the second degree.
