ORANGE CO., Ind. (WHAS11) -- Indiana State police say an Orange County, Indiana husband shot and killed his wife with their three kids nearby. Police call it negligence, but friends of the family say it was a freak accident.
“I was outside and saw Henry run outside with the kid,” said Emily Lloyd, who lives across the street from the shooting. “I went over there and didn’t know what to do.”
It was a frightful Saturday night for neighbors on North Franklin Street in Orleans, Indiana.
Police say just before 6 p.m. Saturday, John Henry Rutherford was showing his 12-gauge shot gun to some young males when he accidentally discharged it. The shot immediately killed 37-year-old Jody Rutherford, who was at home with her three kids.
Neighbors of the Rutherford's say they were a very loving family and never seemed to have any marital problems.
Word of Jody Rutherford's death has been upsetting news for the Orleans community with a population of about 2,200 people.
“It shocked everybody,” said Mark Bloecher, who is a neighbor of the Rutherford’s. “I saw what happened, watching all of it and it’s heartbreaking.”
“She [Jody Rutherford] was a very nice girl,” said Lloyd. “She never judged anybody. She was a good friend to have.”
John Henry Rutherford was arrested and taken to the Orange County Jail. He is facing charges for reckless homicide.
Police tell WHAS 11 News the three children are staying with other family members at this time.
