Oldham County Magistrate Scott Davis speaks out after alleged Derby ticket deal

Louisville, Ky (WHAS11) - Oldham County Magistrate Scott Davis is speaking out for the first time since being charged in a Derby ticket brokering deal.

He faces 20 charges in Clark County, Indiana for allegedly collecting money for tickets he did not deliver.

"I think it remains very  clear that we are the victim of a crime here," says Oldham County Magistrate Scott Davis

Scott Davis says he's surprised by the charges, 20 in all,  10 of them felonies.

"We never in any way intended to defraud or put any customer in a situation of non delivery," says Davis.

The charges range from theft to not registering as a retailer. 

Five victims were named in the probable cause affidavit. People who came in from across the country for the Kentucky Derby, paid for tickets they say they never received  from Davis.

Davis says those people have since been compensated.

Davis places blame on U of L assistant basketball coach Steve Masiello  who he says  failed to deliver the tickets. Masiello was not charged in Clark County  but remains  under investigation in Jefferson County according to Louisville Metro Police.
