LOUISVILLE, Ky. (WHAS11) -- A murder suspect is now on home incarceration after a court appearance Friday morning.
Tony E. Whitfield, Jr., 29 of Louisville, is accused of shooting and killing 37-year-old Terrence Smith in front of the Doll House Gentlemen’s Club on 7th Street Road early Thursday morning.
Whitfield, a Ford Employee, was in a Jefferson County court room Friday and said the shooting was in self-defense.
"We've talked to witnesses your honor. This is an absolute justifiable self-defense case," Whitfield’s lawyer said.
Police said Smith, the victim, and Whitfield were escorted out of the club by security personnel before the shooting occurred. Witnesses said Smith was causing trouble inside the club before the men were taken out.
According to the arrest record, Whitfield pulled out a .40 caliber gun from his waistband.
"You're not obligated to wait to find out if someone is armed. You're not obligated to wait to find out whether someone will physically assault you until you are hospitalized or killed," Whitfield’s attorney said.
Police say the victim was unarmed and died from a gunshot wound to the head. As for Whitfield, his bond was reduced from $100,000 to $50,000 and he was placed on house arrest.
The judge said Whitfield had a previous drug-related charge which was dismissed.
Whitfield will be back in court on the day after Christmas.
