Third Camm trial to be moved north of Indy

SPENCER CO., Ind.(WHAS11) – On Monday night, a judge says he may decide in the next month where the next trial will be held for former Indiana State Trooper David Camm, in the killings of his wife and two children.

That same judge delayed a decision on David Camm's bond.

In handcuffs and a bulletproof vest, David Camm walked calmly into the Spencer County, Ind. Courthouse.

Camm hoped that judge would allow him to await trial outside of prison, somewhere he's been for most of the past 12 years.

"He's not a flight risk because he wants to prove himself innocent. You understand, that's what his job is right now," Camm's uncle Sam Lockhart said.

Camm was arrested in October of 2000, three days after his wife Kim, his 7-year-old son Brad and his 5-year-old daughter Jill were found murdered in their Georgetown, Ind. home.

Camm, a former Indiana State Trooper, was convicted of the murders twice, but both convictions were eventually overturned on appeal.

His attorney argued Monday that Camm should be granted bond, because delays were caused by the misconduct of former prosecutor Keith Henderson, who was thrown off the case after the Indiana Supreme Court ruled a book deal about the case created a conflict of interest.

"Had Mr. Henderson recognized the fact that he had a conflict and withdrawn from the case, the trial would have already been over," Camm's attorney Richard Kammen said.

The prosecutor said this.

"The rules that he has to be released doesn't apply to this situation, when it's a mistrial. When there's a mistrial, the only question is when's a reasonable time to try him," Prosecutor Stan Levco said.

The one thing both sides agreed on Monday was to move Camm's trial to a county north of Indianapolis.

The judge is expected to decide on exactly where and whether or not Camm will be released on bond, within the next 30 days.
