LOUISVILLE, Ky. (WHAS11) -- The owner of the now defunct Heavenly Angels Child Care Centers was due in court Monday morning.

Lewars is facing theft and fraud. WHAS11 first brought the allegations against Lewars earlier this month after an I-Team investigation. Lewars has been hard to track down since 14 children from one of her now closed day cares were injured in a crash while riding in a day care van.

Monday she was required to be in court for arraignment on charges she defrauded the state out of more than $300,000 intended for children of low income working parents.

As it turns out, the judge had to move the arraignment until next Monday. Lewars was issued a criminal summons rather than the $25,000 full cash bond prosecutors had sought in the case.

Lewars is accused of operating a fraudulent scheme during the last calendar year in which she allegedly billed the state for children who did not actually attend her daycare.

WHAS11 will continue to follow this story and will be there next Monday when Lewars is due back in court.
