Despite texting while driving ban, judges dismiss charges

LOUISVILLE, Ky. (WHAS11) –In the two years since Kentucky has had a texting while driving ban, judges in Jefferson County have dismissed nearly 40 percent of those charges.

An estimate 900 texting while driving charges have been filed across the state in the past two years.

Statewide, 25 percent of the charges were dismissed and prosecutors got convictions in just 63 percent of the cases that went forward.

Police and prosecutors admit the ban is very difficult to enforce but Kentucky crash statistics do show a slight drop in the number of distracted driving accidents since the ban went into place.
