LOUISVILLE, Ky. (WHAS11) -- Attorney General Jack Conway released a letter regarding Metro Councilman David James, and whether he could serve as a police officer and be a member of the Metro Council at the same time.

In February Jefferson County Attorney Mike O'Connell questioned whether Councilman James can hold two offices requiring him to swear an oath.

On Monday, March 17, the attorney general's letter said because James was promoted to a major in September with the UofL Police that oath could be incompatible with his oath to serve on the council.

He says the person who legally handles this type of situation is the Jefferson County Commonwealth’s Attorney Thomas Wine, and will leave the issue to be settled by Wine's office.
