Louisville, Ky. (WHAS) – The fight over a smoking ban in Bullitt County may be on its way to the state supreme court.
The Kentucky Court of Appeals ruled on Friday two to one that the Bullitt County Board of Health can enact a smoking ban without lawmakers support.
The appeals court overturned a Bullitt County Circuit Court decision citing three key points.
The Board has the authority to impose regulations or ordinances involving public health.
Second-hand smoke is a health issue and the ordinance is reasonable.
