LOUISVILLE, Ky. (WHAS11) -- Stan Curtis, the well known founder of some of Louisville's best known charities will not appear in federal court this week to answer theft charges.

Lawyers for Curtis said their client is not mentally competent.

Curtis is still in a Louisville nursing home with a brain disorder, and appeared frail and confused on December 20th when he was expected to plead guilty.

According to his attorney, they've now asked for a third delay.

The U.S. Attorney's Office has said it will ask for an independent medical examination of Curtis.

Curtis is accused of stealing $183 thousand from USA Harvest; spending $370 thousand on personal expenses and failing to report a half million dollars in income.
