Marksberry lawsuit: Ky Democratic Party should not help Grimes

LOUISVILLE, Ky (WHAS11) -- Democratic U.S. Senate candidate Ed Marksberry has filed suit against Kentucky Democratic Party chairman Daniel Logsdon after the party voiced support for another Democratic candidate, Alison Lundergan Grimes, in an apparent violation of its own rules.

Filed in Franklin Circuit Court, Marksberry's suit said the party cited its bylaws' prohibitions against favoring one primary candidate over another when it declined to help Marksberry spread the word about his campaign in December.

Yet, Marksberry's suit says when Grimes announced her candidacy on July 1,  the state Democratic Party released an email in support of Grimes and her fundraising efforts.

"Clearly, resources of Kentucky Democratic Party were utilized to promote Alison Lundergan Grimes' campaign and denied to supporting the candidacy of Edward Marksberry," the suit reads.

The lawsuit seeks to restrain Logsdon and the party from further supporting Grimes or any other Democratic candidate prior to the primary election.

Marksberry, an Owensboro building contractor, lost to Republican Brett Guthrie in the 2010 Second Congressional District race.
