Mother charged in deadly crash enters not guilty plea

Fouch entered a plea of not guilty to all charges on Monday, Sept. 25. 

CLARK CO., Ind. (WHAS11) – It was an emotional day in court as a Henryville mother, accused of being under the influence of drugs during the crash that killed her children, appeared in court.

Investigators say Ericka Fouch was under the influence of marijuana, Xanax and meth when her vehicle collided with a train in June.

Police arrested Fouch on Friday afternoon, nearly four months after the crash. She remained composed in front of the cameras but broke down in the courtroom.

Fouch's children, 5-year-old Adalynn and 4-year-old Wyatt, were pronounced dead at the scene.

She entered a plea of not guilty to all charges.

Fouch is facing two charges of neglect of a dependent resulting in death, two charges of operating a motor vehicle while under the influence of a controlled substance and one charge of driving while suspended.

If convicted, Fouch could face up to 42 years in prison.
